Purpose
The decree transposes EU Directives 91/156/EEC, 91/689/EEC, and 94/62/EC, establishing a comprehensive legal framework for the management of waste, hazardous waste, and packaging, aimed at environmental protection, public health, and promoting the recovery and proper disposal of waste.
Scope of application
It applies throughout Italy and covers all stages of waste management: production, collection, transport, recovery, disposal, and trade, including packaging and packaging waste. Regions and autonomous provinces adopt implementing measures in accordance with the fundamental principles of the decree.
Main features and mechanisms
It sets out general principles of responsibility and cooperation among producers, distributors, consumers, and public authorities. It includes measures to prevent the generation and hazardousness of waste, promote clean technologies, eco-auditing systems, eco-labels, and the development of environmentally low-impact products. It establishes authorisation and control procedures, integrated management systems, rules for waste recovery and disposal, and penalties for non-compliance.
