Purpose

- Certain substances and mixtures are partially exempted, such as those used in cosmetics, medicinal products, food and feed, and substances subject to other specific EU legislation.
- It also applies to the labelling and packaging requirements for substances and mixtures intended for professional or consumer use.

- The regulation replaces previous EU directives on classification, labelling, and packaging to create a single, consistent legal framework across all Member States.
Scopo
- Il regolamento istituisce un sistema armonizzato per la classificazione, l’etichettatura e l’imballaggio di sostanze e miscele nell’Unione europea.
- L’obiettivo è garantire un elevato livello di protezione della salute umana e dell’ambiente fornendo informazioni chiare e coerenti sui pericoli chimici.
- Mira inoltre a facilitare il commercio e la conformità normativa all’interno dell’UE allineando le regole europee al Sistema Globale Armonizzato delle Nazioni Unite (GHS) per la classificazione e l’etichettatura delle sostanze chimiche.
Ambito di applicazione
- Il regolamento si applica a tutte le sostanze chimiche e miscele immesse sul mercato dell’UE.
- Copre fabbricanti, importatori, utilizzatori a valle, distributori e fornitori di prodotti chimici all’interno dell’Unione.
- Alcune sostanze e miscele sono parzialmente esentate, come quelle utilizzate nei cosmetici, nei medicinali, negli alimenti e nei mangimi, o soggette ad altra legislazione specifica dell’UE.
- Si applica anche ai requisiti di etichettatura e imballaggio per sostanze e miscele destinate all’uso professionale o da parte dei consumatori.
Caratteristiche e meccanismi principali
- Il regolamento stabilisce criteri armonizzati per la classificazione dei pericoli basati sulle proprietà fisiche, sanitarie e ambientali delle sostanze e miscele.
- Definisce pittogrammi di pericolo standard, parole di segnalazione, frasi di rischio e frasi di prudenza da utilizzare in etichettatura.
- Specifica requisiti di imballaggio per garantire la sicurezza nella manipolazione, nel trasporto e nello stoccaggio, inclusi chiusure a prova di bambino e avvertenze tattili per determinate sostanze.
- Richiede ai fornitori di fornire schede di dati di sicurezza contenenti informazioni dettagliate sui pericoli, sulla gestione sicura e sulle misure di emergenza.
- Include disposizioni per l’aggiornamento della normativa nel tempo, permettendo modifiche ai criteri di classificazione, agli elementi di etichettatura e ai metodi di prova.
- Sostituisce le precedenti direttive dell’UE su classificazione, etichettatura e imballaggio, creando un quadro giuridico unico e coerente in tutti gli Stati membri.
