REGULATION (EU) 2020/852 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 18 June 2020 on the establishment of a framework to facilitate sustainable investment, and amending Regulation (EU) 2019/2088
Purpose
- The regulation establishes a framework for determining whether an economic activity can be considered environmentally sustainable within the European Union.

Main features and mechanisms
- The regulation establishes a taxonomy system that classifies economic activities according to their environmental sustainability.
- It identifies six environmental objectives: climate change mitigation, climate change adaptation, sustainable use and protection of water and marine resources, transition to a circular economy, pollution prevention and control, and protection and restoration of biodiversity and ecosystems.
- An economic activity is considered environmentally sustainable if it substantially contributes to at least one environmental objective, does not significantly harm any of the other objectives, complies with minimum social safeguards, and meets specific technical screening criteria.
- The regulation empowers the European Commission to adopt delegated acts establishing detailed technical screening criteria for determining whether economic activities meet the sustainability requirements.
- Financial market participants must disclose how and to what extent their financial products are aligned with the taxonomy.
- Large companies must provide information on the proportion of their activities that qualify as environmentally sustainable under the taxonomy framework.
- The regulation aims to prevent greenwashing by introducing common definitions and disclosure obligations related to sustainable investments.

- Il regolamento stabilisce un quadro normativo per determinare quando un’attività economica può essere considerata sostenibile dal punto di vista ambientale nell’Unione europea.
- L’obiettivo è orientare gli investimenti verso attività economicamente sostenibili e sostenere la transizione verso un’economia climaticamente neutrale ed efficiente nell’uso delle risorse.
- Contribuisce all’attuazione del Green Deal europeo creando un sistema comune di classificazione delle attività economiche sostenibili e migliorando la trasparenza per investitori e imprese.
- Il regolamento si applica agli Stati membri e all’Unione europea quando stabiliscono misure pubbliche, standard o etichette per prodotti finanziari sostenibili o obbligazioni societarie.

Caratteristiche e meccanismi principali
- Il regolamento istituisce un sistema di tassonomia che classifica le attività economiche in base alla loro sostenibilità ambientale.
- Identifica sei obiettivi ambientali: mitigazione dei cambiamenti climatici, adattamento ai cambiamenti climatici, uso sostenibile e protezione delle risorse idriche e marine, transizione verso un’economia circolare, prevenzione e riduzione dell’inquinamento, e protezione e ripristino della biodiversità e degli ecosistemi.
- Un’attività economica è considerata sostenibile se contribuisce in modo sostanziale ad almeno uno degli obiettivi ambientali, non arreca danni significativi agli altri obiettivi, rispetta garanzie sociali minime e soddisfa criteri tecnici specifici di valutazione.
- Il regolamento attribuisce alla Commissione europea il potere di adottare atti delegati che definiscono criteri tecnici dettagliati per stabilire se un’attività economica soddisfa i requisiti di sostenibilità.
- I partecipanti ai mercati finanziari devono comunicare in che misura i loro prodotti finanziari sono allineati alla tassonomia.
- Le grandi imprese devono fornire informazioni sulla quota delle loro attività che può essere considerata sostenibile secondo il sistema di tassonomia.
- Il regolamento mira a prevenire il fenomeno del greenwashing introducendo definizioni comuni e obblighi di trasparenza relativi agli investimenti sostenibili.
